Terms and Conditions

These terms and conditions (Rules) govern your entry into the Ballarat International Foto Biennale’s (‘Promoter’ or ‘Ballarat International Foto Biennale’) The Golden Ticket Competition presented in partnership with Intrepid Travel.

ENTRY REQUIREMENTS AND ELIGIBILITY

1. Entry is open from 25 July 2025 and closes at 4:00pm AEDT on 19 October 2025 (Competition Period).
2. An entrant must be an individual and not a company or organisation.
3. An entrant must be an Australian citizen aged 18 years or older.
4. Employees (and their immediate families) of the Promoter and agencies associated with this Competition are ineligible for entry to the Competition. Immediate family means any of the following: spouse, ex-spouse, de-facto, spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousins.
5. To be eligible, entrants must:

○ Purchase a valid ticket to the 2025 Ballarat International Foto Biennale during the competition period; and
○ Opt in for the giveaway and agree to these Competition Rules
○ Complete your valid ticket purchase.

6. The following ticket types are considered valid for entry:

○ Single-Day Festival Pass

■ Adult – $42
■ Concession – $36
■ Biennale Friend – $32

○ Season Pass (Unlimited entry for 60 days)

■ Adult – $62
■ Concession – $50
■ Biennale Friend – $45

○ Event Tickets

■ A valid ticket to an event presented as part of the 2025 Ballarat International Foto Biennale Official Program, purchased via the Ballarat International Foto Biennale website.
■ Official events that are offered at the 2025 Ballarat International Foto Biennale by the Promoter’s agents or third-party service providers are exempt.
■ Official events that are not available for purchase the 2025 Ballarat International Foto Biennale website are exempt.

Eligible Concession tickets are available to:

○ Full-time students, over 18 years (including international students)
○ Pension Card holders
○ Carer Card holders
○ Health Care Card holders
Proof of concession must be presented with your ticket at the venue.

7. Group bookings are ineligible.

WINNER SELECTION

1. The draw will take place at 02:00PM AEDST on Monday 17 November 2025.
2. Ballarat International Foto Biennale will randomly select a winner and their decision is final.
3. The winner will be notified in writing by email, SMS or phone submitted at the time of entry. Ballarat International Foto Biennale will make reasonable efforts to identify and locate the Prize Winner.
4. If the Winner does not claim the Prize by 9:00AM AEDST on Monday 1 December, the Prize is forfeited, and a new winner may be chosen by the Promoter.
5. Ballarat International Foto Biennale’s decision and declaration of the Winner is final and no correspondence will be entered into.
6. If any Prizes remain unclaimed within three months after the Prize Draw Date, an unclaimed Prize draw will be held.

PRIZE CONDITIONS

Intrepid Travel x Ballarat International Foto Biennale – The Golden Ticket
1. The winner will receive an Intrepid Travel voucher valued at $15,000 AUD.
2. The prize can be redeemed against any Intrepid small group adventure, excluding the following:

○ Polar
○ Short Break Adventures
○ Urban Adventures
Private Groups (Tailor Made)
○ Expeditions
○ Festival trips

3. The winner may use the voucher to book travel for themselves and/or family or friends, provided they are all travelling on the same Intrepid trip.
4. Travel is subject to Intrepid Travel’s Booking Conditions, found here: https://www.intrepidtravel.com/au/booking-intrepid/booking-conditions.
5. The prize (or any unused portion):

○ Cannot be exchanged for cash
○ Is non-transferable
○ Cannot be used on bookings already made
Cannot be extended

6. The voucher must be booked/redeemed by 31 October 2028, and travel must commence by 15 December 2028.
7. Blackout periods apply:

○ 15 December 2025 – 15 January 2026
○ 15 December 2026 – 15 January 2027
○ 15 December 2027 – 15 January 2028
○ 15 December 2028 – 15 January 2029

8. The prize is subject to availability at time of booking. A minimum of four (4) confirmed travellers is required on the chosen departure for the booking to be validated.
9. The voucher covers land content only. It does not include:

○ Flights
○ Additional accommodation
○ Meals outside the itinerary
○ Transfers
○ Travel insurance
○ Visas
○ Optional activities
○ Spending money
○ Single supplements or local payments

10. Changes to confirmed bookings may incur fees, payable by the winner.
11. To redeem the prize, the winner must contact Intrepid Travel at sales@intrepidtravel.com and quote the promotional code provided to them.

Privacy and Use of Personal Information

1. Personal Information including the Eligible Entrant’s [name, address, telephone number, email] will be collected and used for the purpose of conducting this Competition. This may require disclosure to third parties, including the Promoter’s agents or third-party service providers, for the purpose of conducting the Competition.
2. Please see the Promoter’s privacy policy and collection notice for this Competition for more information about how we use your personal information. GENERAL

4. The Promoter and its affiliates reserve the right to amend or withdraw the prize draw and any of the prizes in the event of any unforeseen circumstances outside their reasonable control. Prizes are subject to availability. In the event of unforeseen circumstances, the Promoter reserves the right to substitute alternative prizes of equivalent or greater value.
5. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
6. Entries are deemed received once competition opt-in is confirmed with inclusion of the Criteria above. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant on transmission. The Promoter is not responsible for any technical problems resulting from any entrant’s participation or sending or receiving of any communications or materials related to the Competition. The Promoter has no obligation to acknowledge any entry.
7. The Winner consents to the Promoter using their name, likeness, image and/or (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome), and promoting the Festival.
8. If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
9. The Applicant agrees to indemnify Ballarat International Foto Biennale and hold them harmless from any damages, liabilities, losses, costs, expenses, obligations or claims (including, without limitation, reasonable outside attorneys’ fees and costs) arising out of the breach of the Applicant’s agreements, obligations, representations and warranties under these Rules.
10. As a condition of claiming the Prize, the Winner may be required to sign any legal documentation as and in the form required by the Promoter and/or reward suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event the Winner is under the age of 18, the prize will be forfeited.

OTHER TERMS AND CONDITIONS

11. You warrant and represent that you have the power and capacity to enter into and to grant the rights contemplated under this Agreement.
12. These Rules are governed by the laws of Victoria, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of courts exercising jurisdiction there.
13. By entering The Golden Ticket Competition you agree to be bound by these Rules.
