Before proceeding it’s important that you read these Terms and Conditions of Sale carefully. These conditions are the basis upon which bookings are accepted by Ballarat International Foto Biennale (BIFB Inc.). If you do not agree with the following Terms and Conditions of Sale then please do not proceed with your booking.

BIFB Inc. is offering its services to you as event tickets to the 2023 Festival and events presented by us and our partners and promoters.

Terms & Conditions of Sale
These terms may vary at BIFB Inc.’s discretion and will be effective upon posting to ballaratfoto.org and available to view at the BIFB Box Office outlets, Lydiard Street, Ballarat. You must agree to them, and any current variations to them, each time you make a purchase from us.

No Cancellations, Exchanges or Refunds.
Once confirmed, bookings may not be cancelled, exchanged or refunded except as required by law or as detailed in these Terms and Conditions.

BIFB Inc. does not offer refunds or exchanges as a result of a change of mind or in personal circumstances. BIFB Inc. can not take responsibility if you do not or cannot attend the exhibition(s) or event(s) confirmed in your booking. A contract will be made between BIFB Inc. and yourself upon confirmation of your booking. Bookings are confirmed when full payment is received. Confirmation of your booking will be sent to the email address that you provided.

To the extent allowed by law, if an event is cancelled, rescheduled or significantly relocated, all liability is limited to the amount for which the ticket was purchased (excluding any fees or charges) and BIFB Inc. will not be liable for any other losses incurred by you including any travel and accommodation expenses. BIFB Inc. may exchange your ticket/s for an alternative date, and if there is no suitable date then a refund will be provided.

Proof of purchase may be required as a precondition to any refund or exchange.

Venue Capacity
We have venue capacity limits to ensure the safety of our patrons. If during peak periods, any venue reaches its capacity, you may be asked to return at a later time on the same day of your visit. If capacity is still exceeded and you are unable to enter the exhibition on the day of your visit, BIFB Inc. may exchange your ticket/s for an alternative date, and if there is no suitable date then a refund will be provided.

Allocated timed entry may be introduced with preferences required via an online form.

We thank you for your understanding and kindly request you follow directions from our friendly event staff during your visit.

Lost Tickets.
BIFB tickets do not have allocated seating. For lost, damaged or stolen tickets, proof of purchase may be required as a precondition to replacement. For enquiries regarding tickets, please contact info@ballaratfoto.org

Children Age Limit.
For seated events, BIFB Inc. will admit free, with no seat allocated, Children 3 years and under for adult style productions. Such children will be expected to sit with their guardian in a paid for seat for the duration of the performance and not occupy a separate seat.

Confirmation email.
For online bookings an automatic booking confirmation will be sent by email and will include the event times, ticket specifics and other details of your order. This email will be sent within 60 minutes of payment being received. You must notify BIFB Inc. immediately if there have been any mistakes with your booking, or if you do not receive the confirmation email after an hour.

No Reselling.
No tickets may be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promoting other commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods or services, either by yourself or another person without express consent of BIFB Inc. If a ticket is involved in a breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission.

Price Changes.
All prices are subject to change without prior notice until your booking is confirmed.

GST.
All prices quoted include the Goods and Services Tax (GST) where applicable.

BIFB Inc. Pricing Policy.
All stated prices are inclusive of GST and credit card charges. BIFB Inc. advertised ticket prices include the base supply cost of the products and all fees charged to and by BIFB Inc. to supply those tickets and packages. Law & Construction.
These Terms and Conditions of Sale, any contract made by a confirmed booking and all directly related matters shall be governed and interpreted exclusively under the law and courts of the State of Victoria, Australia.
Personal information and privacy.

In order to make your booking BIFB Inc. will need to gather some personal information such as your name, address and credit card details. BIFB Inc. will keep your personal information secure and confidential, and will not sell your information to any third party. We follow Australia’s privacy laws and our own Privacy Policy in all our dealings with you. To view our policy, please go to this page.

Normally your purchase will only be provided to you, the purchaser. You may assign your purchase to another person, but you must tell us the name of the intended recipient as part of the order process or using the contact details in your confirmation email. If you do not do this, our privacy policy means that we cannot discuss your purchase with that person and the products or services may not be provided to them. By naming the recipient you give us permission to discuss the details of the booking with that person.

Uncontrollable events.
Certain things lie outside BIFB Inc. control and many situations are unavoidable or not reasonably predictable. Except as required by law, BIFB Inc. is not liable for any loss, inconvenience, damage, additional expense, injury, delay or any other claim in relation to:

  1. Changes to event information, programme, performers or performance dates, including the cancellation or rescheduling of events;
  2. actions or omissions on the part of independent promoters or others outside of BIFB Inc. control, who supply products and services in connection with ticketed events;
  3. unknown or unforeseen defects in any venue, vehicle, device or material used in connection with products sold by BIFB Inc.;
  4. partner and promoter policies or legal regulations including, but not limited to: dress standards, bans on cameras and recording devices, the responsible service of alcohol and safety regulations; or
  5. events which are unforeseeable or not preventable by reasonable diligence on our part including, but not limited to: war, fire, floods, unusually severe weather, acts of God, acts of Government, acts of terrorism, accident, failure of machinery, labour disturbances and acts or omissions of telecommunications and delivery service operators beyond our reasonable control.
    Unenforceability.
    These Terms are not intended to limit your mandatory legal rights and should be read as such. If any part of these Terms is held to be invalid, illegal, unenforceable or in conflict with the law of Victoria it will be disregarded to the extent of its invalidity and the remainder will remain in full force and effect.
